What Causes Most Construction Accidents?
Construction employers are subject to safety regulations established by the Occupational Safety and Health Administration (OSHA) and by state law. Despite these rules, accidents on construction sites are still a fairly common occurrence.
Unfortunately, many of these accidents occur when safety regulations aren’t followed.
All too often, construction accidents and injuries result from:
- Negligent hiring, training, and/or supervision
- Failing to provide workers with necessary safety gear
- Failing to install fall-prevention devices for workers on elevated platforms
- Providing workers with faulty or defective equipment
- Failing to provide workers with safe work environments
- Failing to secure equipment and building materials
Our construction accident attorneys will carefully investigate your case to understand how and why you got hurt. Once we determine the underlying cause(s), we’ll know the best way to advocate for you to get the compensation you need to move forward with your life.
Can I Sue My Employer If I Got Hurt in a Construction Accident?
It depends. You may be able to file a civil personal injury lawsuit against your employer if (a) they don’t have workers’ compensation insurance and (b) their negligence or wrongful actions contributed to your construction accident.
If you’re covered by workers’ compensation, you’ll generally waive the right to sue your employer. However, you can often reserve the right to file a civil action against another party who is fully or partly responsible for your construction accident.
This could include a/an:
- Property owner
- General contractor
- Equipment manufacturer
- Co-worker
- Motorist
- Government agency
- Engineer
- Architect
If you file a lawsuit, you can request economic damages (to offset your financial losses) and non-economic damages (to help you handle harder-to-value trauma), which can include money for:
- Current and future medical bills
- Lost wages and benefits
- Disability
- Nursing care
- Rehabilitation
- Costs paid out of pocket
- Funeral expenses if a construction accident is fatal
- Pain and suffering
- Chronic physical pain
- Loss of companionship
- Loss of enjoyment of life
- Emotional distress
- Disfigurement and scarring
Punitive damages can also be awarded if your construction accident lawsuit makes it to trial. If a settlement can’t be reached, a jury may have the discretion to award punitive damages, which are intended to punish a defendant whose actions were intentional, malicious, or highly reckless.
Will I Qualify For Workers’ Compensation Benefits?
Many states require employers to carry workers’ compensation insurance once they reach a minimum number of employees. If you work for a qualifying employer, you may be able to seek benefits through their insurance policy as long as you:
- Were injured while performing tasks or responsibilities within the scope of your employment, and
- Are classified as an employee, not an independent contractor.
Workers’ compensation is typically a no-fault system that can provide benefits for medical treatment, temporary and/or permanent disability, and rehabilitation. If a construction accident is fatal, eligible family members may also qualify for death benefits for the cost of a funeral and lost financial support.
Common Construction Accident Injuries
No matter your trade, it’s possible to suffer serious, potentially life-changing injuries when there’s an accident on your job site.
At 844-SPARTAN, we help construction workers who’ve sustained:
- Broken bones and fractures
- Nerve damage
- Soft tissue injuries
- Chest injuries
- Crushing injuries
- Amputation injuries
- Degloving injuries
- Burns
- Whiplash injuries
- Neck injuries
- Back injuries
- Herniated discs
- Spinal cord injuries
- Quadriplegia
- Concussions
- Traumatic brain injuries
- Eye injuries
- Catastrophic injuries
Report your construction accident to your supervisor immediately. Then, get prompt medical care. These steps can make or break your ability to recover compensation in the future.
What If I’m Partly At Fault For a Construction Accident?
You may still be able to recover compensation. It’ll depend on the type of claim you file and how much, if any, liability you share.
Claims for workers’ compensation are generally not affected by comparative negligence. Since it’s a no-fault system, benefits are awarded even if you contributed to your construction accident (with limited exceptions).
However, many states apply modified comparative negligence rules to personal injury claims involving shared fault. In these situations, damages are reduced proportionately to fault and may be barred entirely if your share of fault meets or exceeds a set threshold (often 50% or 51%).
How Long Will I Have to File a Legal Claim After a Construction Accident?
Deadlines depend on the type of claim and your jurisdiction.
- Workers’ compensation claims: Many states require you to report the injury quickly (sometimes within days) and file a formal claim within a short period (often around one year or less).
- Personal injury lawsuits: Statutes of limitations vary by state, but many jurisdictions set a deadline around two years from the date of injury.
Don’t miss the applicable filing deadline. Once the statute of limitations runs out, you could lose the ability to recover compensation to help you move forward with your life.
